A straw purchase of a firearm occurs when an individual legally buys a gun and then gives it to another person who is prohibited from owning firearms. This is usually a federal crime. However, if a firearm is purchased as a gift, it is not considered a straw purchase and the buyer is regarded as the end user. A weapon purchased for another person, but not purchased from a gun dealer, is also legal unless the gun is used in a crime with the prior knowledge of the provider of the firearm. Surveys show that people attempt to illegally buy guns from dealers at least 35,000 times each year. Some of these illegal buyers convince gun dealers to keep transactions off the books. Some of these buyers also use stand-ins such girlfriends or wives to avoid background checks. Gun control advocates say the primary sources of guns for criminals are theft from private homes and straw purchases.

  • I oppose reforming current firearm straw purchase policy and wish to donate resources to the campaign committee of either Rep. Paul Ryan or Sen. Mitch McConnell
  • I support providing an additional sentence of two years imprisonment for violating the prohibitions against making false statements or misrepresenting identification regarding the acquisition of a firearm or ammunition knowing that the violation will further the transfer of two or more firearms to a person prohibited by law from shipping, transporting, possessing, or receiving a firearm; or with the intent to conceal such person's identity from the transferor; prohibits the court from placing any person convicted of such violation on probation; prohibits a term of imprisonment imposed under this Act from running concurrently with a term imposed on the person under any other legal provision; directs the Attorney General to issue regulations requiring any form required to be completed by the purchaser of a firearm from a licensed firearms dealer to include a notice of the provisions of this Act, and wish to either reintroduce H.R.404 - Straw Purchaser Penalty Enhancement Act (113th Congress 2013-2014), or a similar version thereof, and also wish to donate resources to the campaign committee of Rep. Adam Schiff (CA) or to an advocate group currently working with this issue

Trustee Candidates

If elected as a trustee, the campaign committee of Rep. Adam Schiff (CA) will be unconditionally awarded the funds pledged to this issue along with a letter requesting him to favorably consider either reintroducing H.R.404 - Straw Purchaser Penalty Enhancement Act (113th Congress 2013-2014), or a similar version thereof.

If elected as a trustee, Everytown will be awarded the funds pledged to his issue along with a letter requesting these funds be used to advocate for increased enforcement of laws relating to the straw purchase of firearms, and harsher punishments for those convicted of such crimes.

Everytown for Gun Safety, formerly Mayors Against Illegal Guns is dedicated to making America's cities safer by cracking down on illegal guns. It states that 30,000 Americans are killed every year as a result of gun violence, destroying families and harming communities. Mayors have a responsibility to protect their communities by holding gun offenders and irresponsible gun dealers accountable, demanding access to trace data that is critical to law enforcement efforts to combat illegal gun trafficking, and working with legislators to fix gaps, weaknesses and loopholes in the law that make it far too easy for criminals and other prohibited purchasers to get guns. Everytown supports the Second Amendment and the rights of citizens to own guns. It recognizes that the vast majority of gun dealers and gun owners carefully follow the law. And it knows that a policy that is appropriate for a small town in one region of the country is not necessarily appropriate for a big city in another region of the country. More than 1,000 mayors from big cities and small towns from across the country have joined the coalition of Everytown are all are committed to working with fellow mayors to share best practices, develop innovative policies, and support legislation at the national, state and local levels that will help law enforcement target illegal guns. Everytown supports ammunition background checks as a one solution to attaining their goal.
